Agreement to Terms
By accessing or using the Riviera Coffee website located at rivieracoffee.com (the "Site"), including any content, products, and services offered through the Site, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting unless otherwise stated. 1. Intellectual Property Rights
All content on this Site including but not limited to text, graphics, logos, photography, brand assets, packaging design, and product descriptions is the exclusive property of Riviera Coffee Company Inc. ("Riviera Coffee," "we," "us," or "our") or is used under license from third parties. All rights are reserved under applicable United States copyright, trademark, and intellectual property law.
You may not reproduce, distribute, modify, create derivative works from, publicly display, publish, upload, or transmit any material from this Site for any commercial purpose without our express prior written consent. Unauthorized use of Riviera Coffee's intellectual property is strictly prohibited and may result in legal action.
2. Permitted Use
This Site is provided for your personal, non-commercial use only. By using this Site, you agree that you will not:
- Use the Site in any manner that violates applicable federal, state, local, or international law or regulation, including the Federal Trade Commission Act, the CAN-SPAM Act, the Computer Fraud and Abuse Act, or any applicable consumer protection laws;
- Engage in any conduct that restricts or inhibits any other user's use or enjoyment of the Site;
- Attempt to gain unauthorized access to any portion of the Site, its servers, or any system or network connected to the Site;
- Use any automated means, bots, scrapers, or data mining tools to access, collect, or copy content from the Site without our prior written permission;
- Transmit any unsolicited commercial communications or spam;
- Impersonate or misrepresent your affiliation with any person or entity.
You agree to indemnify and hold harmless Riviera Coffee Company Inc. for any unauthorized use you make of materials on this Site.
3. User Submissions and Feedback
We welcome your reviews, comments, and suggestions. By submitting content to our Site including product reviews, comments, or any other materials you agree that:
- You are solely responsible for the content of your submissions;
- Your submissions will not be unlawful, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable;
- Your submissions will not infringe upon any third party's intellectual property, privacy, or proprietary rights;
- You grant Riviera Coffee Company Inc. a perpetual, irrevocable, royalty-free, non-exclusive, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display your submissions in any form or media for any lawful purpose, including marketing and promotional use, without compensation or further consent from you.
We reserve the right to remove any submission at our discretion.
4. Accuracy of Information
All content on this Site is provided for general informational purposes only. While we make reasonable efforts to keep information accurate and current, we make no warranties regarding the completeness, accuracy, reliability, or availability of any content on this Site. Flavor notes and tasting descriptors used on this Site are characteristics of each coffee's natural origin profile and are not representations of added ingredients or additives.
We are not obligated to update any content on the Site and disclaim all liability arising from reliance placed on any materials by you or any third party.
5. Third-Party Links
This Site may contain links to third-party websites, including our wholesale platform. These links are provided for convenience only. Riviera Coffee Company Inc. does not own, operate, or control any third-party sites and is not responsible for their content, accuracy, or practices. Accessing any third-party site is at your own risk and is subject to that site's own terms and conditions.
6. Purchasing Products & Account Registration
You must be at least eighteen (18) years of age to register for an account and purchase products on this Site. If you are under eighteen (18), you may only purchase products with the verified consent and involvement of a parent or legal guardian.
By creating an account, you represent and warrant that:
- You meet the applicable age requirement;
- All information you provide is accurate, current, and complete;
- You are responsible for all activity and transactions conducted through your account;
- You will maintain the confidentiality of your account credentials and notify us immediately of any unauthorized access.
We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, including where we believe your conduct violates applicable law or is detrimental to our business interests or other customers.
7. Limited Drop Releases
Riviera Coffee offers limited-edition single origin coffee releases ("Drops") on a rotating, time-limited basis. By participating in a Drop purchase, you acknowledge and agree that:
- Drop products are available in limited quantities and for a limited time only;
- All Drop sales are final once the Drop period has ended or stock is exhausted, whichever occurs first;
- Riviera Coffee makes no guarantee of product availability at the time of purchase attempt;
- Drop product availability, pricing, and scheduling are subject to change without prior notice;
- Riviera Coffee reserves the right to cancel, modify, or reschedule any Drop at its sole discretion.
8. Recurring Subscriptions
By enrolling in a Riviera Coffee subscription, you authorize us to charge your selected payment method on a recurring basis according to your chosen subscription frequency until the subscription is canceled or paused.
Billing: You will be charged the same amount per subscription order unless you modify your subscription configuration. Price changes, if any, will be communicated to you in advance in compliance with applicable subscription billing laws, including the FTC's Negative Option Rule (16 C.F.R. Part 425) as updated effective 2024, and applicable state auto-renewal laws including the California Automatic Renewal Law (Cal. Bus. & Prof. Code § 17600 et seq.).
Cancellation: You may cancel your subscription at any time through your account portal on our Site, by emailing info@rivieracoffee.com, or by calling 480-802-8077. Cancellation requests submitted by email or phone will be processed within 72 hours. Cancellation will take effect prior to your next scheduled billing date provided the request is received at least 48 hours in advance of that date.
Pausing: Subscriptions may be paused through your account portal. A paused subscription will remain inactive until your specified resume date or, if no resume date is set, indefinitely until you choose to reactivate.
Freshness: All subscription orders are roasted to order and shipped promptly following your billing date. We do not pre-roast or warehouse subscription coffee.
9. Shipping Policy
Riviera Coffee's core promise is freshness. We do not roast your coffee until your order is placed. All orders are roasted to order and shipped as promptly as possible following roast completion.
- Orders are shipped within the contiguous United States only unless otherwise stated;
- Shipments are fulfilled via UPS and/or USPS at published carrier rates based on destination and order weight;
- Shipping weight may differ from product weight due to packaging materials;
- Shipping charges, where applicable, will be displayed at checkout prior to purchase;
- Subscription orders qualify for free standard shipping;
- All prices displayed on this Site are in U.S. Dollars (USD);
- Riviera Coffee is not responsible for delays caused by carrier disruptions, weather events, or circumstances beyond our control.

10. Customer Satisfaction
We stand behind every bag we roast. If you are unsatisfied with your order for any reason, please contact us at info@rivieracoffee.com within 14 days of delivery and we will work to make it right. Because coffee is a perishable food product, all sales are generally final — but we are committed to resolving any genuine issue with your order.
11. Disclaimer of Warranties
This Site and all products and services available through it are provided on an "as-is" and "as-available" basis without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, Riviera Coffee Company Inc. disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
12. Limitation of Liability
To the maximum extent permitted by applicable federal and Arizona state law, Riviera Coffee Company Inc. and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of this Site or any products purchased through it including but not limited to loss of profits, data, goodwill, or other intangible losses — even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the Site shall not exceed the total amount paid by you to Riviera Coffee in the twelve (12) months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Riviera Coffee Company Inc. and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your violation of these Terms; (b) your use of the Site; (c) your violation of any law or the rights of any third party; or (d) any content you submit to the Site.
14. Privacy
Your use of this Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using this Site, you consent to the data practices described in our Privacy Policy, including our use of cookies and third-party analytics tools in compliance with applicable law.
15. Governing Law & Dispute Resolution
These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
Informal Resolution: Before initiating any formal dispute, you agree to contact us at info@rivieracoffee.com and provide a written description of the dispute. We will attempt to resolve the matter informally within 30 days.
Binding Arbitration: If informal resolution is unsuccessful, any dispute, claim, or controversy arising from or relating to these Terms or your purchase of products through this Site shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as amended from time to time.
Class Action Waiver: YOU AND RIVIERA COFFEE COMPANY INC. EACH WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING OF ANY KIND. All claims must be brought in your individual capacity only.
Any arbitration award may be entered as a judgment in any court of competent jurisdiction. If any portion of this arbitration agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
16. California Residents
Pursuant to California Civil Code Section 1789.3, California residents are entitled to the following consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
17. Miscellaneous
These Terms, together with our Privacy Policy, Shipping Policy, Subscription Policy, and Refund Policy, constitute the entire agreement between you and Riviera Coffee Company Inc. with respect to your use of this Site and supersede all prior agreements. If any provision of these Terms is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
